Welcome to Dreamscape Balloon Design! These Terms and Conditions outline the rules and regulations for the use of our website and services. Please note that we have updated and/or corrected these Terms and Conditions (see “Last updated” date above). We encourage you to read them carefully, as they apply to your booking, rentals, delivery, setup, and/or installation. By accessing this website and/or using our services, you agree to comply with these terms. If you disagree with any part of these terms, please refrain from using our services.
1. Introduction
Dreamscape Balloon Design (“Company”, “we”, “us”, or “our”) offers balloon design services for various events, including weddings, birthdays, corporate functions, and more. These Terms and Conditions govern your use of our website and the services we provide.
2. Acceptance of Terms
By using our website or placing an order, you accept and agree to be bound by these Terms and
Conditions, including any additional policies we publish. By placing a deposit with Dreamscape
Balloon Design, you further acknowledge that you have read, understood, and agreed to all Terms and Conditions outlined by our company. This includes our policies regarding product use, weather risks, cancellations, and liability. The deposit serves as confirmation of your acceptance of these terms and secures your event date. All deposits are non-refundable and are subject to the conditions listed herein.
3. Orders and Payments
• Order Process: All orders are subject to acceptance by Dreamscape Balloon Design. We reserve the right to refuse any order at our discretion.
• Deposit: A 50% deposit is required at the time of booking to secure your event date and design. The deposit is non-refundable but may be transferred to another date or event if requested at least 7 days prior to the event.
• Delivery, Installation, and Teardown Fee: A 30% fee of the total project cost will be added to cover delivery, installation, and teardown services. This fee applies to all events and will be clearly outlined in your final invoice.
• Payment Terms: The remaining balance (after the deposit) must be paid in full at least 3 days prior to the event unless otherwise specified. If your event is booked within 10 days or less of the event date, full payment is required at the time of booking.
• Rush Orders: A $75 rush fee will be added to all orders booked 10 days or fewer before the event date. Rush orders are subject to availability and may be declined if scheduling cannot accommodate them.
• Pricing: Prices for our services are subject to change without notice. We strive to provide accurate pricing, but errors may occur. In such cases, we reserve the right to correct the pricing before proceeding with your order.
• Cancellations: Cancellations made after the deposit is received will result in forfeiture of the deposit, as detailed in our cancellation policy.
4. Cancellation Policy
• Non-refundable Deposit: The 50% deposit paid at the time of booking is non-refundable. This secures your event date and covers the initial preparation work for your balloon design.
• Cancellations by Client:
If you cancel your event, your deposit is non-refundable.
• Cancellations by Dreamscape Balloon Design:
In the unlikely event that we must cancel your booking due to unforeseen circumstances, we will refund your deposit and any other payments in full or work with you to reschedule the event at no additional cost.
• Rescheduling: If you need to reschedule your event, please contact us at least 30 days in advance. We will make every effort to accommodate your new date, but availability is not guaranteed. The non-refundable deposit will be applied to the rescheduled event if it is within 12 months of the original event date.
5. Delivery and Setup
• Delivery: We offer delivery services for our balloon designs, subject to availability and location. The 30% delivery, installation, and teardown fee will apply to cover all necessary logistics for the event.
• Setup: Our team will coordinate with you to ensure timely setup of the balloon designs at your event. It is your responsibility to provide accurate event details, including timing and location.
6. Client Responsibilities
• Event Information: It is your responsibility to provide accurate event details, including location, time, and any special requirements. Failure to provide the correct information may result in delays or cancellations, and additional fees may apply.
• Use of Balloons: Our balloon designs are intended for decorative purposes only. Dreamscape Balloon Design is not liable for any injuries or damages resulting from the misuse of balloons or associated materials.
7. Changes and Modifications
• Amendments to Orders: If you need to make changes to your order, please notify us at least 10 days before your event. We will do our best to accommodate changes, but certain adjustments may incur additional costs.
• Design Changes: We will work with you to ensure your balloon designs meet your vision. However, we reserve the right to make modifications to the design if necessary due to availability of materials or other factors.
8. Refunds and Returns
• Refund Policy: Due to the custom nature of our balloon designs, all sales are final. Refunds will only be issued in the case of a significant error on our part.
• Returns: We do not accept returns of balloon products once they have been delivered and set up at the event.
9. Liability
• Event Cancellations: Dreamscape Balloon Design is not liable for cancellations due to unforeseen circumstances such as natural disasters, accidents, or venue-related issues. We recommend event insurance for these occurrences.
• Damages: We are not responsible for any damages to the balloon designs after setup is completed and the event is underway. Balloons are fragile and susceptible to weather conditions, temperature, and sharp objects.
10. Intellectual Property
• Content: All content, images, designs, logos, and materials on our website are the property of Dreamscape Balloon Design and are protected by copyright and trademark laws. You may not use any of our intellectual property without written permission.
• Photography Consent: If the client does not consent to event photography for marketing purposes, they must notify Dreamscape Balloon Design in writing before the event. Otherwise, we reserve the right to take and use event photos of our work for promotional purposes, including use on our website, social media, and marketing materials.
11. Third-Party Links
Our website may contain links to third-party websites. These links are provided for convenience only, and we are not responsible for the content, privacy policies, or practices of any third-party sites.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Oklahoma, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on this page with a revised date. Your continued use of our services following the posting of changes constitutes your acceptance of such changes.
14. Balloon Shine & Product Use Disclaimer
Some of our balloon displays may be treated with professional-grade balloon shine products to enhance appearance and longevity. These products may contain silicone or similar compounds.
By using our services, you agree to the following:
• Handling & Safety: Customers and guests should avoid touching treated surfaces, especially if they have skin sensitivities or allergies. Keep children supervised around balloon displays.
• Risk Acknowledgment: Balloon shine may cause skin irritation or allergic reactions in rare cases. Balloons may also present choking or tripping hazards.
• Liability: Dreamscape Balloon Design is not responsible for any injury, irritation, or damage resulting from the use or contact with balloons or balloon shine.
15. Weather & Heat Disclaimer
Balloon displays are highly sensitive to environmental conditions, especially in Oklahoma’s climate. By using our services, you agree to the following:
• Heat and Sunlight: Exposure to direct sunlight or high temperatures can cause balloons to pop, fade, or oxidize. Wind and humidity may also affect the integrity of balloon structures.
• Outdoor Setup Guidance: If indoor setup is not available, we strongly recommend that you provide a fully shaded area for installation. This helps extend the lifespan and appearance of your decor.
• Client Responsibility: If our team advises against an outdoor or sunlit setup and you proceed anyway, Dreamscape Balloon Design is not liable for damage or early deflation.
• No Refunds: We do not provide refunds or replacements for weather-damaged balloons after setup is complete.
• Weather Backup Plan Acknowledgment: For outdoor events, the client is responsible for arranging a suitable backup plan (indoor space, tent, or shade) in case of inclement weather. Dreamscape Balloon Design is not liable for delays, cancellations, or decor failure due to the absence of a weather contingency plan.
16. Equipment & Rental Item Disclaimer
Any equipment or decor rented from Dreamscape Balloon Design must be returned in the condition it was delivered. The client is responsible for the replacement or repair costs for any damaged, lost, or stolen rental items. A refundable security deposit may be required for certain rentals.
17. Site Accessibility & Setup Conditions
The client is responsible for ensuring that the event site is accessible, safe, and ready for installation at the agreed-upon time. This includes clear access to doors, pathways, and setup areas. If conditions delay or prevent setup, additional fees may apply or installation may be canceled without refund.
18. Allergies & Latex Sensitivity Notice
Our balloons may contain latex. If any guests have a latex allergy or sensitivity, please notify us in advance so we can explore alternatives. Dreamscape Balloon Design is not responsible for allergic reactions caused by latex products.
19. Client Delays or No-Show Policy
If the client or a designated representative is not present at the agreed setup time and this results in delays of more than 30 minutes, an additional fee may apply. If no contact is made within 1 hour of the scheduled time, we reserve the right to cancel the installation with no refund.
20. Force Majeure
Dreamscape Balloon Design shall not be held liable for delays, cancellations, or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, labor disputes, or utility failures. In such cases, we will work with the client to reschedule the event or provide partial refunds at our discretion.
21. Social Media Tagging Encouragement
Clients are encouraged to tag @DreamscapeBalloonDesign when sharing event photos on social media. This helps promote our work and allows us to engage with your celebration. While tagging is not required, it is greatly appreciated!
22. Dispute Resolution
In the event of any dispute arising from services provided by Dreamscape Balloon Design, both parties agree to first attempt to resolve the issue through informal negotiation. If a resolution cannot be reached, both parties agree to submit the matter to mediation before pursuing any formal legal action.
23. Event Photography for Collaborations
In styled shoots or collaborative events, Dreamscape Balloon Design reserves the right to be credited as a contributing vendor in all photography shared publicly. Clients and collaborators agree to share any professional photos with us upon request for use in our marketing materials.
24. Cleaning & Venue Policy
Dreamscape Balloon Design is not responsible for post-event cleanup or removal of balloon remnants unless teardown service is included in your package. Some venues may charge a cleanup fee for loose balloons or decorations. It is the client’s responsibility to confirm venue policies and notify us of any restrictions in advance. Additional cleaning or venue violation fees incurred due to balloons or decor left behind are the responsibility of the client.
25. Digital Design Mockups Disclaimer
Any digital renderings, mood boards, or mockups provided are for conceptual and illustrative purposes only. Final installations may vary in color, scale, or style due to lighting conditions, venue constraints, material substitutions, or artistic interpretation. We strive to deliver highquality work that aligns with your vision, but exact duplication of mockups is not guaranteed.
26. Early Teardown Fee
If the client requests early removal or teardown of balloon decor prior to the originally scheduled event end time, additional charges may apply. This fee will be based on required labor, travel, and scheduling availability. Requests for early teardown must be made at least 24 hours in advance and are not guaranteed unless confirmed in writing.
27. Damage Waiver for Venue Property
Dreamscape Balloon Design takes care during setup and teardown. However, we are not liable for any damage to venue surfaces, fixtures, walls, or ceilings caused by installation materials (e.g., adhesives, hooks, stands) unless due to gross negligence. Clients are responsible for confirming that decor installation is permitted by the venue.
28. Venue Approval Responsibility
It is the client’s responsibility to confirm that balloon installations are permitted by the venue.
This includes restrictions on helium tanks, adhesives, large decor, power use, or setup times. Dreamscape Balloon Design is not responsible for denied access or restricted setup due to venue policy violations or miscommunications with venue staff.
29. Indemnification Clause
The client agrees to indemnify, defend, and hold harmless Dreamscape Balloon Design and its owners, employees, agents, and subcontractors from and against any claims, damages, liabilities, losses, or expenses (including attorney’s fees) arising out of or in connection with the client’s use of our services, violation of these Terms and Conditions, or any third-party claims related to the event.
30. Limitation of Liability Clause
In no event shall Dreamscape Balloon Design be liable for any indirect, incidental, special, or consequential damages arising out of or relating to our services. Our total liability to you for any claim shall not exceed the total amount paid by you for the services in question.
31. Assumption of Risk Clause
By engaging Dreamscape Balloon Design, the client assumes all risks associated with the use of balloons and event decor, including but not limited to tripping hazards, choking hazards, allergic reactions, and weather-related damage. The client agrees that Dreamscape Balloon Design is not responsible for injuries or damages once the decor is installed.
32. Photography & Video Release
By hiring Dreamscape Balloon Design, you grant us the right to photograph and/or film our work at your event, unless otherwise stated in writing before the event. These images or videos may be used for promotional purposes across digital and print platforms. You agree that no additional approval or compensation is required.
33. Service Refusal Right
Dreamscape Balloon Design reserves the right to refuse service to any event or client for any reason, including but not limited to safety concerns, harassment, or unreasonable demands. In such cases, a refund will be issued at our discretion.
34. Design Ownership
All balloon arrangements, arch designs, and installation concepts created by Dreamscape Balloon Design are the intellectual property of the company. Clients may not reproduce, resell, or copy these designs for commercial purposes without written consent.
35. Client Supplied Items Disclaimer
If the client provides materials (such as signs, props, or custom decor) to be used in the balloon setup, Dreamscape Balloon Design is not responsible for damage, loss, or return of these items.
We reserve the right to refuse unsafe or unsuitable materials.
36.Outdoor Installation – Wood Backdrop Requirement & Damage Liability
If the event setup/installation is outdoors (including covered patios, tents, porches, or any location subject to wind, moisture, humidity, condensation, heat, or direct sunlight), Client must select a wood backdrop for the rental/install. Non-wood backdrops are not permitted for outdoor installs due to increased risk of instability, warping, and damage. If Client requests an outdoor install without a wood backdrop, Company may refuse installation, require the setup to be moved indoors, or cancel the setup without refund of any non-refundable fees.
Client is fully responsible for any damage, loss, or excessive wear to the backdrop(s) and related rental items occurring during an outdoor event, including but not limited to damage caused by wind, rain, moisture, heat, mud, uneven ground, sprinklers, guests, vendors, or other environmental conditions. Any repair, replacement, cleaning, or re-installation costs resulting from outdoor-related damage will be billed to Client and may be charged to the card on file or deducted from the security deposit (if applicable).
37.Travel Fee- Mileage Beyond 20 Miles
Delivery, setup, and/or installation includes travel up to 20 miles from Company’s designated base location. For travel beyond 20 miles, Client agrees to pay an additional $0.40 per mile, calculated on the miles exceeding 20 miles (based on the route distance as determined by the Company using a standard GPS mapping service). This mileage fee may be added to the final invoice and is due prior to delivery/setup unless otherwise stated in writing.
38. Rental Item Damage, Loss, and Cleaning Liability
Client assumes full responsibility for the care, condition, and security of all rental items provided by DreamscapeBalloonDesign from the time of delivery/setup until DreamscapeBalloonDesign pickup/strike is completed (or until items are returned to DreamscapeBalloonDesign if return is permitted). Rental items include balloons/garlands (“balls”), mirror box(es)/plinths/pedestals, all signs (welcome signs, seating charts, bar signs, directional signs, tabletop signs), and all boards/backdrops/panels/stands/frames, including any hardware, bases, weights, clamps, fasteners, or accessories provided with them. Client is liable for any damage, excessive soiling, missing parts, or loss/theft of any rental item, whether caused by Client, guests, venue staff, vendors, weather, or any other third party. Damage includes, but is not limited to: scratches, scuffs, dents, chips, cracks, breaks, warping, swelling, delamination, water damage, staining, paint transfer, fading, burns/scorch marks, adhesive residue, tape marks, sticker/vinyl removal damage, writing/marker damage, bent frames/stands, broken bases/feet, missing hardware, or any condition beyond normal wear. Client agrees that no tape, command strips, glue, hot glue, staples, nails, screws, tacks, adhesives, stickers, confetti, glitter, paint, or markers may be applied to any rental item, and Client may not move, alter, disassemble, or reposition rentals once installed without DreamscapeBalloonDesign’sapproval; any resulting damage will be charged to Client. For balloons/garlands specifically, Client understands balloons are sensitive to heat, sun, wind, sharp surfaces, and handling; popping, deflation, oxidation, or appearance changes after setup due to environmental conditions or interference are the Client’s responsibility and are not refundable. If any rental item is damaged, excessively dirty, missing, or not available at the scheduled pickup time, Client agrees to pay the full cost of cleaning, repair, or replacement (at DreamscapeBalloonDesign’sdetermination), including associated labor and materials; DreamscapeBalloonDesign may charge the card on file and/or deduct from any security deposit (if applicable), and Client agrees to pay any remaining balance within the timeframe stated on the invoice.
